1. Introduction
These Terms and Conditions govern the provision of guest booking services provided by Earworm Agency Limited (“we”, “us”, “our”) to you. By using our services, you agree to these Terms and Conditions in full.
2. Service Description
We offer a guest booking service that includes identifying suitable podcast opportunities, pitching, negotiating interview dates, and managing all communication between you and the podcast hosts. Our service is designed to enhance your visibility and reach by securing guest spots on podcasts that align with your profile and objectives.
3. Provision of Information
You agree to provide all necessary information required for us to effectively pitch you as a guest on various podcasts. This information should be submitted through the guest booking brief page on our client hub and must accurately represent your work and public profile.
4. Fees and Payment
The fee for each successful guest booking is £245 + VAT. An invoice will be raised upon confirmation of a guest speaking slot by all parties involved and is payable within 7 days of the invoice date.
5. Communication
All communications between you and the podcast hosts we book you on must be conducted through us, as we act as your agent in this context. Should a podcast host contact you directly, you are required to refer them to us for all communications.
6. Liability
You are solely responsible for the content of your discussions and any statements made during podcast appearances. We are not liable for any issues or disputes that arise as a result of your statements or conduct during these appearances.
7. Cancellation and Termination
Either party may terminate this agreement with written notice. Upon receipt of a cancellation request from you, we will cease all pitching activities. However, payment is still required for any interviews already booked. We reserve the right to terminate this agreement for reasons including, but not limited to, no-shows, misconduct during podcast interviews, or non-payment, with termination notice provided via email.
8. Rebooking and Rescheduling
We will manage all aspects of rebooking and rescheduling. We request that you provide a minimum of 24 hours’ notice for any changes to scheduled interviews to accommodate the podcast hosts’ schedules.
9. Confidentiality and Information Sharing
Information provided to us for the purpose of guest pitching will be shared with third parties, including podcast hosts, producers, and other web service providers, as necessary to facilitate your bookings.
10. Intellectual Property
Unless otherwise agreed, the intellectual property rights of the podcast content will belong to the podcast host or their designated entity. We are not responsible for any edits made by the podcast host to the content. In the event of a dispute arising from content misrepresentation, we will support our guests and liaise with the podcast to address the issue.
11. Dispute Resolution
Disputes arising under these Terms and Conditions will be addressed through email correspondence and, if necessary, resolved via a Google Meet session to reach a mutually agreeable solution.
12. Amendments
These Terms and Conditions may be amended from time to time. Any amendments will be communicated to you in writing.
